By browsing the website or purchasing a product / service from iCanvas.co.za you agree to be legally bound by the following terms and conditions. Please read through these carefully before placing an order:

Copyright

The images, Artwork and designs used by iCanvas.co.za are the property of iCanvas.co.za or their respective copyright owners and are used by iCanvas.co.za with express authorisation. You must not use, reproduce, modify or distribute images, any part of images or content in any form without prior written authorisation.

By supplying us with artwork, you warrant that you have the copyright or license for that image or the written permission of the copyright owner to use the photograph. Under no circumstances will iCanvas.co.za be responsible for any copyright issues arising as a result of you, the customer, supplying us with any image or artwork in breach of copyright. You will indemnify iCanvas.co.za against any costs or damages arising from the reproduction of any image you submit to iCanvas.co.za

Any custom art creations from the Art Gallery (excluding YourArt from your photos) remain the intellectual property of iCanvas and are licensed to the customer for private use.

In some cases a print license for the artwork will be obtained (in the customer’s name) from the relevant publisher – this will grant the customer rights to personal / private use of the artwork

Site Content + Products

Descriptions of goods and services included in the iCanvas.co.za website are accurate to the best of our knowledge. We do our best to correct errors or omissions as soon as we are aware of them. The Site and the goods sold through it are subject to change without notice and we reserve the right to improve, alter, modify or withdraw designs / products at any time without prior notification. We may terminate or suspend the operation of this web site (or terminate or suspend provision of any products or services offered via this web site) for support or maintenance work, in order to update the content or for any other reason. We may do this at any time and without notice.

You are advised to keep back ups of all material provided to us. In particular, it is up to you to keep backup copies of images uploaded by you or emailed to us. We will not be responsible for keeping backups or for loss of, deletion or corruption of any images or any other material.

Products are subject to availability. If a product the customer has ordered becomes unavailable due to circumstances beyond our control, the customer will be notified and we will supply substitute goods.

Product Sizes: due to the nature of manufacturing customised products by hand, there will be marginal size differences in the finished item to the sizes quoted on this web site. Occasionally we may substitute materials and adjust product design to accommodate production considerations in relation to supply or stock shortages.

Print Sizes: Not all the artwork from the gallery section can be printed at the maximum available print sizes. Should you request a large print from such an image, we will advise you of your options. Most of the gallery images can be enlarged to the maximum size options, some with an acceptable level of digital artifacts.

YourArt and your Photos

Note - All example Images used to demonstrate the Yourart Styles are good guides for what your art from your photo will look like. We do not warrant that the final item will be exactly as per the example images contained in this web site since each photo is individual and demands it’s own unique treatment. We will endeavor to apply the treatments to bring out the best in your photos and to deliver a final product that closely corresponds to the example images.

We recommend uploading your digital or scanned photos. Should you want to post in your photo for us to scan, we strongly recommend that copies are made before sending them to us as we cannot accept responsibility for items lost or damaged in transit. Your photograph/artwork will be returned to you with your canvas print.

You agree to allow iCanvas.co.za to archive your digital images for the purpose of reordering. These images will only be used when you give your express permission.

Print Colour Variation

You should be aware that the colours and appearances of images in print may vary from the way they appear on a screen and that computer monitors vary in colour depending on their calibration, make and model. If a proof of an image is emailed to you and approved we cannot then be held responsible if the colour on the final canvas differs slightly. To ensure the best possible colour matching, please make use of our ColourMatch service by supplying us with Pantone swatch codes.

Payment

We are not obliged to supply the goods to you or undertake work until we have confirmed that we have accepted your order and received payment in full. Payment can be made for the artwork online via Credit Card through our payment provider (Setcom.com) or via Bank Transfer:

Gift Vouchers

Any remaining balance left after redeeming a gift voucher is non refundable; however, you (the customer) can add to the remaining balance. Gift vouchers can be redeemed up to twelve months from date of issue.

Shopping cart system

It is the responsibility of the customer to use the shopping cart in the correct manner and to apply certain discounts / coupons as prescribed. We reserve the right to refuse or adjust an order (with the customer’s consent) which was entered incorrectly. Please see the comprehensive Help section for help on using the shopping cart. Example: If a certain discount coupon was applied to the wrong promotion or product, the order will not be processed before the difference has been settled.

Prices

iCanvas.co.za reserves the right to alter prices without notice.  All prices are in South African Rand and include Value Added Tax where applicable.

Right to refuse

iCanvas.co.za reserves the right to refuse photos / images which is of very low quality or in contradiction with our business morals and principles. This may include but is not limited to: poor photos / image, immoral or illegal materials.

Order Cancellation

iCanvas.co.za cannot cancel works which have been initiated and paid for. If work has been undertaken on YourArt creations and have not been printed / framed – we may be able to Refund the amount paid for the print only. If you cancel payment with your card provider rather than following our refund policy, you will be liable for the fee charged to iCanvas by your provider. Chargebacks will be thoroughly investigated and if necessary, will be referred to relevant investigative or law enforcement agencies.

Returns Policy

Due to the bespoke nature of our artworks, items that are delivered as described and in good condition - may not be returned. All our Prints are checked for quality before they are dispatched.

In the event that artwork was damaged during transit, do NOT accept the delivery from the Courier – please inspect the packaging thoroughly before accepting delivery.

In the unlikely event that the goods delivered are faulty then we will exchange the goods free of charge, providing the goods are returned to us within 7 working days from the date of delivery.

iCanvas.co.za will not exchange any goods if the customer is dissatisfied with the chosen artwork. The customer is responsible for checking and approving any artwork or image manipulation done by iCanvas.co.za. Orders will only be dispatched once this approval has been given by the customer.

Delivery

We will commence work on your order as soon as payment (and artwork, if required) is received. Delivery of the finished print normally takes 14 days from receipt of payment upon which work will be undertaken and the customer will be contacted to approve the image proof via email. Any delay by the customer in responding to the proofing e-mail will cause a corresponding delay in fulfilling the order. If you require delivery sooner than the average 14 day turn around, or would like to request a specific delivery date, please specify this when placing your order and we will try our best to accommodate your request. Please note however that once parcels have been passed onto our chosen courier we cannot be held responsible for any delays that occur in transit.

Unfortunately, we are unable to give a ‘guaranteed’ time of delivery since we use external couriers and do not have control over direct circumstances (or any acts of nature) that might impact on the delivery timeline. If a delivery is late due to your location, accidents or local disruptions iCanvas.co.za will not be liable for any consequential loss.

Please ensure that you check your delivery before signing for it. iCanvas.co.za will not accept liability for missing or damaged items unless this is brought to the attention of the delivery company. Please do not sign for your goods until you have physically checked them and are satisfied that they are in perfect condition. Faulty or damaged goods: You must check goods on delivery. In cases of damaged of faulty goods, this fact must be communicated to the delivery company and delivery rejected. You should then notify iCanvas.co.za immediately so we can arrange for an exchange.

Satisfaction Guarantee

In the light the foregoing terms on Returns and Delivery we value our customers and we go to great lengths to ensure the highest possible quality product is delivered. Should you not be satisfied with the print quality or workmanship of your artwork, notify us and return the artwork within 7 working days in it’s original packaging, in the condition it was received and we will reprint the same artwork for you at no extra charge.

Privacy Policy

We are committed to the privacy and security of your personal information. When you order, we need to know your name, email address, phone number and delivery address. This allows us to process your order and to notify you of the status of your order. We do not sell your personal information to others.

We may occasionally email you with special iCanvas offers and new services. If you receive these, you will have the opportunity to unsubscribe yourself from any further messages on the email you have received.

Law and jurisdiction

These terms (and the provision of goods and services by us) are governed by and to be interpreted in accordance with South African law. In the event of any dispute arising in relation of these terms or in relation to the provision of any goods and services by us the South African courts will have exclusive jurisdiction over such dispute.
